The use of private finance schemes, increasing commercialisation and the establishment of Foundation Trusts are all areas that have revealed complex taxation issues for NHS Trusts.
There is a widespread feeling amongst finance managers that many of these issues need clarification and consultation to ensure that regulations are applied consistently and fairly.
Some of the issues that need to be addressed are:
- The establishment and provision of clear and consistent guidelines
- Consultation on strategic issues
- Quicker settlement of tax issues
- A need for a formal appeal process and independent assessment
No avenue currently exists for high level consultation on these and other policy issues
The Forum was formed to meet this need. Its remit is to discuss these issues between Trust Directors and Managers and take them forward in a constructive manner with HM Revenue & Customs, the Department of Health and other relevant Government bodies.
Current topics include:
- VAT treatment of PFI schemes
- University of Glasgow - payment of VAT on supply of medical staff
- Lennartz - VAT recovery on business use of space
- Administrative Burden of complying with tax matters
- Corporation Tax and Foundation Hospitals
Terms of Reference
- To ensure consistency, accuracy and fairness in the application of VAT and Corporation Tax to government departments and agencies and other public sector bodies.
- To consider issues arising from the application of VAT and Corporation Tax to government and public sector bodies.
- To raise issues with HM Revenue & Customs, The Treasury and parent government departments for consultation.
- To consider and propose changes to the administration and operation of VAT and Corporation Tax that would facilitate their application to government and public sector bodies.
- To consider and propose changes to policy applying to VAT and Corporation Tax.
- To provide a forum for discussion and consultation on all related matters.
- To share best practice on tax accounting.
- To promote, and assist members obtain, value for money on all tax dealings.
- To promote, and assist members with, tax efficiency planning.
- The Forum will cover England and Wales only.
